As the Senate Judiciary Committee holds confirmation hearings, Brett Kavanaugh’s previous statements about the role of money in politics and political corruption loom large.
The signs are worrying.
- In SpeechNow.org v. FEC, Kavanaugh voted to allow wealthy donors to give unlimited amounts of money to PACs that were "independent" from candidates. The decision was responsible for creating super PACs, which can now raise and spend as much money as they want in elections.
- Brett Kavanaugh has written that money is “absolutely” speech, and believes that campaign finance laws can be justified only to combat outright bribery. The Framers of the Constitution disagreed: Of the 325 uses of the word “corruption” in documents related to the Constitutional Convention, only five referred explicitly to quid pro quo bribery. Kavanaugh’s position is in conflict with the Framers and out of step with the American people. He deserves a chance to set the record straight and clarify his views.
